Terms of Service

1. Subscription Terms

Assist by The Email Lady (“Assist”) is a subscription service priced at $97 per month. Your subscription begins at the end of your free trial period (14 days) and renews automatically each month until canceled. By subscribing, you authorize us to charge your payment method on a recurring basis.

2. Free Trial

New users receive a 14-day free trial with full access to all features. No credit card is required to begin your trial. At the end of the trial, you must subscribe to continue using Assist.

3. Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation, you will retain access to Assist until the end of your current billing period. No refunds are provided for partial billing periods. There are no cancellation fees.

4. Acceptable Use

You agree to use Assist only for lawful purposes and in compliance with all applicable laws. You may not:

  • Use Assist to send spam or unsolicited communications.
  • Attempt to gain unauthorized access to our systems or other users’ data.
  • Use Assist in any way that could damage, disable, or impair the service.
  • Resell, sublicense, or redistribute Assist without written permission.
  • Violate Klaviyo’s or Shopify’s terms of service through your use of Assist.

5. Intellectual Property

All content generated by Assist for your campaigns (copy, designs, strategies) is yours to use. The Assist platform, its code, design, and branding remain the property of The Email Lady LLC.

6. Limitation of Liability

Assist is provided “as is” without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to lost revenue, data loss, or business interruption. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

7. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the service. Continued use of Assist after changes constitutes acceptance of the updated terms.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
